Bruce MacFarlane (University of Manitoba) testifies under direct examination by Commission Counsel Michel Dorval about various challenges related to the prosecution of large, complex criminal cases in Canada. Mr. MacFarlane discusses the “empanelling” of juries and various challenges related to juries, including juror intimidation and problems with jurors’ comprehension of long, complex trials. Mr. MacFarlane makes a series of policy recommendations. Commissioner John C. Major asks a series of detailed questions.
