Supreme Court Hearings - Her Majesty the Queen v. J.A.
Her Majesty the Queen v. J.A. - November 8, 2010
At issue in this appeal is whether a person can consent in advance to sexual activity that will take place when the person is unconscious. J.A. was convicted of sexual assault after an encounter with his long-time girlfriend K.D. Although K.D. had agreed to be choked unconscious, she claimed that she did not consent to being sodomized, a statement she later recanted. The couple had previously taken part in activities that included bondage and asphyxiation.
