Merck Frosst Canada Ltd. v. Minister of Health - November 12, 2010 Case #33320 and #33290 This appeal deals with the disclosure of information that one party considers to be confidential. Health Canada received requests under the Access to Information Act for its records on Singulair, an asthma drug that is manufactured by Merck Frosst. Merck Frosst argued that Health Canada had no right to disclose any of the requested documents, as the documents were submitted in confidence to Health Canada to obtain regulatory approval. Merck Frosst stated that the documents represented millions of dollars in potentials sales for its competitors if they were disclosed. Health Canada had already disclosed certain documents without notifying Merck Frosst.
