Olga Maria Nixon v. Her Majesty the Queen - December 15, 2010 Case #33476 The Supreme Court must decide if the Crown has the power to revoke a plea agreement. In 2006, Wade and Karen Andriashek were killed and their seven-year-old son Jessie was injured after their car was hit by Olga Nixon’s car. Nixon was charged with impaired driving causing death and bodily harm. A plea bargain was reached where Nixon would plead guilty to the lesser charge of careless driving, but the Crown withdrew the agreement before a guilty plea was entered. Nixon alleges that the revoked agreement is an abuse of process and breaches her Charter rights.
