Marko Miljevic v. Her Majesty the Queen – December 17, 2010
Marko Miljevic was convicted of second-degree murder in the 2007 death of Matt McKay at a party in Calgary. Miljevic, who was 19 at the time, hit 17-year-old McKay in the head with a pickaxe. He was sentenced to life in prison with no chance of parole for 10 years.
The jury had asked the trial judge to explain the difference between second-degree murder and manslaughter. Miljevic argues that the judge did not adequately answer the jury’s question.
