Her Majesty the Queen in Right of British Columbia, et al. - February 24, 2011 Case #33563 The Supreme Court is hearing appeals on the federal government's duty of care in two cases where tobacco companies are being sued. In appeal #33559, consumers who bought light or mild cigarettes in British Columbia want a refund from Imperial Tobacco Canada for alleged misrepresentation. Imperial Tobacco argues that the federal government should share costs because it helped to develop and market the light cigarettes. In appeal #33563, British Columbia is suing tobacco companies to recover smoking-related health care costs. The tobacco companies argue that the federal government should also be held liable. British Columbia was the first jurisdiction in Canada to sue the tobacco industry.
