Banro Corporation is a global mining company that is based in Ontario, while the appellants work and reside in Quebec. The appellants wrote and published a French book in Quebec that was later released in Ontario and referenced on various websites and newspaper articles. The book “Noir Canada” details the operations of Canadian corporations in Africa and contains statements about Banro, which has mining operations in the Democratic Republic of the Congo. The appellants are also being sued for libel in Quebec by mining company Barrick Gold for $6 million.
