Her Majesty the Queen v. Ex-Private St-Onge, D. – March 24, 2011
The respondent is a former member of the Canadian Forces who pleaded guilty to four disciplinary offences and the unauthorized possession of marijuana. St-Onge appealed the sentence of 30 days’ imprisonment which the military judge imposed on him.
The majority of the Court Martial Appeal Court allowed St-Onge’s appeal and substituted a $3,000 fine for the prison sentence. The Crown is appealing the Court Martial Appeal Court’s decision to substitute the military judge’s sentence.
