Her Majesty the Queen v. Yat Fung Albert Tse, et al. (November 18, 2011)
The Supreme Court of Canada heard arguments on the constitutionality of warrantless wiretaps in emergency situations.
Police in B.C. used warrantless wiretaps in a 2006 case in which a drug trafficker and two other people were kidnapped. While the six respondents were convicted, the Crown is appealing the trial judge’s ruling that invalidated the emergency wiretap provision of the Criminal Code.
