Matthew Leslie Maybin and Timothy Andrew Maybin v. Her Majesty the Queen (December 15, 2011) Case # 34011 The appellants are brothers who were involved in a bar fight in 2006 that resulted in the death of 20-year-old Michael Brophy. The Maybins and Buddha Gains, a bouncer at the bar who had hit the victim while he was unconscious, were acquitted of manslaughter. The Crown appealed the acquittals and the B.C. Court of Appeal ordered a new trial for the brothers, but it upheld Gains' acquittal. Brophy's cause of death was internal bleeding in the brain, but it could not be determined which of the accused inflicted the fatal blow. The appellants are asking the Supreme Court of Canada to restore their acquittals of manslaughter.
