The Supreme Court of Canada is holding an oral hearing on an application for leave to appeal. The applicant was charged with possession of cocaine for the purposes of trafficking and possession of currency obtained by the commission of an offence. The trial judge found his Charter rights had been breached and excluded the evidence pursuant to Section 24(2) of the Charter. The applicant was acquitted at trial. The Court of Appeal allowed the appeal and ordered a new trial.
