Erin Lee MacDonald, et al. v. Her Majesty the Queen, et al. (May 23, 2013) Case # 34914 The appellant was convicted of several firearms-related offences. The appellant was rude and intoxicated while entertaining some friends at his condo in downtown Halifax. The appellant was politely and repeatedly asked to turn down the volume of his music. When the appellant finally responded to police at the door he did so while carrying a loaded restricted firearm. A police struggle over the weapon ensued. The appellant argued that the police’s search violated his Charter rights but the trial judge ruled the search was justified.
