Case # 34997 Michael McCormick v. Fasken Martineau Dumoulin LLP (December 13, 2013) The appellant is an equity partner in the respondent law firm. The partnership is limited liability, registered under the Partnership Act. The appellant turned 65 years old in March 2010. Pursuant to a Partnership Agreement, the appellant was required to retire as an equity partner at the end of 2010. The appellant filed a complaint with the B.C. Human Rights Tribunal accusing the firm of age discrimination. The respondent applied to dismiss the complaint on the basis that the tribunal doesn’t have jurisdiction over the complaint. The Tribunal dismissed the respondent’s application and the respondent sought judicial review.
