Case # 35372 Her Majesty the Queen v. Guy Auclair, et al. (January 21, 2014) At issue is whether the trial judge erred in finding certain anticipated delays unreasonable. In April 2009, a police operation led to the arrest of more than 150 people associated with the Hells Angels. The prosecutor authorized the preferring of a direct indictment against these persons. The indictment were for 29 counts, including 22 for murder, one for conspiracy to commit murder, and others related to drug trafficking. The trial judge ordered a stay of proceedings for all charges unrelated to murder, on the basis the delays would have been unreasonable. In a majority decision, the Crown’s appeal was dismissed.
