Case # 35375 Commission des normes du travail v. Asphalte Desjardins Inc. (March 28, 2014) From 1994 to 2008, an employee worked for the respondent, Asphalte Desjardins Inc. The respondent earned more than 80% of its income from road paving contracts. During that period, there were also times when the employee worked for other employers. The employee initially worked as a surveyor and then became project manager. In 2008 the employee announced he intended to resign and leave his job permanently, givingthe respondent three weeks notice. The employee stated that he was leaving to join a competitor that was offering him better salary terms. The respondent, however, decided to waive the notice and terminate employment immediately. The Commission des normes du travail instituted a proceeding against the respondent. The Commission sought to require the respondent to pay the employee during the notice period.
