Attorney General of Canada v. Federation of Law Societies of Canada (May 13, 2014)

The Federation of Law Societies of Canada petitioned the British Columbia Supreme Court for a declaration. The declaration stated that certain provisions of the proceeds of crime and terrorist financing act are unconstitutional. The declaration stated that the provisions infringe on solicitor-client privilege. It also stated that the provisions also undermine the independence of the bar granted under the charter. The legislation requires lawyers and notaries to record details of financial transactions. The details of financial transactions can be accessed by law enforcement officials. The Federation of Law Societies of Canada commenced a constitutional challenge to the act and its regulations.
