In this case, a registrar in bankruptcy directed ontario’s ministry of transportation to issue licence plates to a driver. The driver had declared bankruptcy as a result of toll charges on highway 407. At issue in both cases is whether governments are entitled to withhold privileges from drivers who’ve been discharged from their debts.

In this case the respondent an uninsured driver who was at fault in a car accident. The respondent declared bankruptcy after being unable to pay a judgment against him. The respondent was discharged of his debts. The government of Alberta suspended his licence and privileges. At issue in both cases is whether governments are entitled to withhold privileges from drivers who’ve been discharged from their debts.
