Case # 35527 David Caplin v. Minister of Justice of Canada (April 23, 2015) Case # 35548 Attorney General of Canada v. Anthony Barnaby (April 23, 2015) At issue are the standards of due process in extradition and surrender orders. The United States is seeking the extradition of both Caplin and Barnaby for the murder of two women. Caplin and Barnaby are accused of first and second degree murder in the killing of the two women in Cctober 1988. Both women were stabbed to death in their apartment In october 1988 in Nashua, New Hampshire. In 1990 David Caplin was charged but a successful motion to exclude evidence left prosecutors without a case, and the charges were dropped. In 1989, barnaby was indicted on two counts of first degree murder. Barnaby proceeded to trial on three occasions, in 1989 and 1990. Each trial ended in a hung jury, as a unanimous verdict could not be reached. In 2010 the New Hampshire state authorities reopened their investigation and new arrest warrants were obtained for both Barnaby and Caplin.
