Robert Hartshorne and Kathleen Hartshorne were married in 1989. Ms. Hartshorne signed a marriage agreement at the behest of Mr. Hartshorne immediately prior to the marriage that stipulated, among other things, that their property would remain separate in the event of a divorce. Ms. Hartshorne signed the agreement even though her legal counsel at the time warned her not to do so. The couple separated in 1998. During the divorce proceedings, there were disputes over custody and access, spousal and child support, and division of property. The courts ultimately held that the original agreement was unfair. Robert Hartshorne is appealing that decision to the Supreme Court.
