Senators continue their review of a private member's bill (C-304) to repeal Section 13 of the Canadian Human Rights Act, which bans hate speech transmitted over the Internet or by telephone. Hate speech would still be prohibited under the Criminal Code.
Law professors Kathleen E. Mahoney (University of Calgary) and Jane Bailey (University of Ottawa), as well as Jo-Ann R. Kolmes with the Women's Legal Education and Action Fund (LEAF), urge senators to reject the bill from Conservative MP Brian Storseth and outline why the section should be maintained.
Bailey was co-counsel on the first Internet hate speech case to come before a Canadian Human Rights Tribunal. Mahoney and Kolmes were co-counsel when LEAF intervened in the Supreme Court hearing that dealt with hate speech provisions in the Saskatchewan Human Rights Code.
UPDATE: Bill C-304 received royal assent on June 26.
