Joseph and David Ryan drowned at sea after the fishing vessel they crewed capsized.
Proceeding under the Marine Liability Act their estates and families commenced an action against a number of defendants.
The action claimed negligence in the design, construction and inspection of the vessel.
The defendants applied to the Workplace Health Safety and Compensation Commission, which determined the action was statute-barred.
Upon judicial review, that decision was set aside and the majority of the Court of Appeal upheld the reviewing judge’s decision.
