Her Majesty the Queen in Right of the Province of Newfoundland and Labrador v. AbitibiBowater Inc., et al. (November 16, 2011) Case #33797 The Newfoundland and Labrador government is appealing a Quebec court ruling that shifted the obligation and expense of cleaning up environmental contamination caused by AbitibiBowater from the company to the province. The government wants AbitibiBowater to clean up the environmental contamination on five industrial sites that the Montreal-based insolvent paper company once owned and operated in the province. AbitibiBowater argues that it no longer has any environmental obligations because it filed for protection under the Companies’ Creditors Arrangement Act. The province estimates that cleaning up the sites will cost more than $100 million.
