Case # 35424 Robert Meredith, et al. v. Attorney General of Canada (February 19, 2014) The Treasury Board is the employer of the members of the RCMP. The Royal Canadian Mounted Police Act provides that the Treasury Board shall establish the pay and allowances paid to members of the RCMP. Following the 2008-2009 worldwide financial crisis the Treasury Board approved a modification to a previously approved RCMP pay package. The pay package which had promised pay increases for the years 2008 to 2010. The pay package had also included pay increments for economic increases and market adjustments. The appellant, on behalf of RCMP staff, sought judicial review to quash the decision of the Treasury Board. The application for judicial review also sought a declaration that the Treasury Board decision violated RCMP members’ Charter rights. Shortly thereafter, the Expenditure Restraint Act was enacted by the federal government. The Expenditure Restraint Act specifically supported the Treasury Board’s limits on pay. The appellant then amended his review application to include a challenge of the new act’s constitutionality.
